नकली रेमडेसिविर केस: जबलपुर के आरोपी ने सुप्रीम कोर्ट में दी हिरासत को चुनौती, मप्र व केंद्र सरकार को नोटिस

नकली रेमडेसिविर इंजेक्शन की खरीद-फरोख्त में जबलपुर से हिरासत में लिए गए एक आरोपी की याचिका पर सुप्रीम कोर्ट ने सोमवार को केंद्र व मध्य प्रदेश सरकार को नोटिस जारी किया है। इस आरोपी पर कोरोना की दूसरी लहर के दौरान नकली इंजेक्शन बेचने का आरोप है। उसने अपनी रासुका में हिरासत को सुप्रीम कोर्ट में चुनौती दी है।

जस्टिस डीवाई चंद्रचूड व जस्टिस एएस बोपन्ना की पीठ ने केंद्रीय गृह मंत्रालय और मप्र के गृह विभाग के सचिवों को नोटिस जारी किए हैं। आरोपी देवेश चौरसिया ने मप्र हाईकोर्ट में उसके द्वारा दी गई हिरासत को चुनौती देने वाली याचिका खारिज होने के बाद सुप्रीम कोर्ट की शरण ली है। शीर्ष कोर्ट ने दोनों सरकारों से दो सप्ताह में जवाब मांगा है।

वकील अश्विनी कुमार दुबे के जरिए दायर याचिका में देवेश ने कहा है कि हिरासत आदेश में मुझ पर राष्ट्रीय सुरक्षा कानून (NSA) 1980 लगाने का जो आधार बताया गया है, वह उचित नहीं है। याचिका में दलील दी गई है कि एनएसए के प्रावधानों के अनुसार हिरासत में लेने वाले प्राधिकारी को रिकॉर्ड पर यह बताना आवश्यक है कि संबंधित आरोपी कैसे कानून व्यवस्था और सामाजिक सुरक्षा के लिए खतरा है?

याचिका में कहा गया है कि याचिकाकर्ता को लंबे समय से हिरासत में रखने के बाद आज दिनांक तक यह नहीं बताया गया है कि उस पर एनएसए क्यों लगाया गया है? आरोपी 10 मई 2021 से हिरासत में है।

ऐसे ही मामले में सुप्रीम कोर्ट जबलपुर के एक डॉक्टर की हिरासत के आदेश को रद्द कर चुकी है। सुप्रीम कोर्ट ने जबलपुर के सिटी अस्पताल के निदेशक सरबजीत सिंह मोखा द्वारा मध्य प्रदेश हाईकोर्ट के 24 अगस्त, 2021 के आदेश को खारिज करते हुए यह आदेश पारित किया था। हाईकोर्ट ने हिरासत के खिलाफ संविधान के अनुच्छेद 226 के तहत दायर आरोपी की याचिका को खारिज कर दिया था। इसे मोखा ने सुप्रीम कोर्ट में चुनौती दी थी।

डॉ. मोखा पर आरोप था कि उसने चौरसिया व अन्य के साथ सांठगांठ कर नकली रेमडेसिविर इंजेक्शन खरीदे और ये कोरोना के मरीजों को लगाकर अवैध मुनाफा कमाया। इस तरह आरोपियों ने आम जनता की जान को खतरे में डाला। शीर्ष अदालत ने दो आधारों पर डॉ. मोखा का हिरासत आदेश अमान्य कर दिया था। इसमें एक था कि अपीलकर्ता की शिकायत पर निर्णय लेने में मध्य प्रदेश सरकार ने देरी की और दूसरा यह कि केंद्र और राज्य सरकार ने अपीलकर्ता को उसकी अपील खारिज होने की सूचना भी समय पर नहीं दी।
