रेप और हत्या के मामलों में पीड़ितों की कम उम्र मृत्युदंड देने के लिए पर्याप्त आधार नहीं: सुप्रीम कोर्ट
सुप्रीम कोर्ट ने कहा कि बलात्कार और हत्या के मामलों में पीड़ितों की कम उम्र को मृत्युदंड देने के लिए ‘इस अदालत की ओर से एकमात्र या पर्याप्त आधार’ नहीं माना गया है. इसके साथ ही कोर्ट ने अपने फैसले का जिक्र किया जिसमें पिछले 40 साल में उसकी ओर से निपटाए गए 67 इसी तरह के मामलों का विश्लेषण किया गया था.
सर्वोच्च न्यायालय की यह अहम टिप्पणी इरप्पा सिद्दप्पा की अपील पर आई है, जिसे निचली अदालत ने दोषी ठहराया था और मौत की सजा सुनाई थी.
कर्नाटक हाईकोर्ट ने छह मार्च, 2017 को निचली अदालत के फैसले को बरकरार रखा था. इरप्पा को 2010 में कर्नाटक के एक गांव में पांच साल की बच्ची के अपहरण, बलात्कार और हत्या के आरोप में दोषी ठहराया गया था.
जस्टिस एल नागेश्वर राव, जस्टिस संजीव खन्ना और जस्टिस बीआर गवई की पीठ ने बलात्कार, हत्या और सबूतों को नष्ट करने के अपराधों के लिए सिद्दप्पा की दोषसिद्धि की पुष्टि की, लेकिन मृत्युदंड की सजा को रद्द कर दिया और इसे 30 साल की अवधि के लिए आजीवन कारावास में बदल दिया.
पीठ की ओर से न्यायाधीश खन्ना की ओर से लिखे गए फैसले में कहा गया, ‘हम सत्र अदालत की ओर से सुनाई गई और उच्च न्यायालय की ओर से बरकरार रखी गई मौत की सजा को कम कर आजीवन कारावास करने के लिए पर्याप्त कारक पाते हैं. इस निर्देश के साथ कि अपीलकर्ता धारा 302 (हत्या) के तहत अपराध के लिए समय से पहले रिहाई या छूट का हकदार नहीं होगा जब तक कि वह कम से कम तीस साल तक कारावास में नहीं रहे.’
पीठ ने यह भी कहा कि सजाएं साथ-साथ चलेंगी. पीठ ने कहा कि हालांकि इस तरह का अपराध जघन्य था और निंदा की आवश्यकता थी, यह दुर्लभ से दुर्लभ नहीं था, इसलिए समाज से अपीलकर्ता को हटाने की आवश्यकता थी.
पीठ ने बलात्कार और हत्या के मामलों में पीड़ितों के नाबालिग होने के आधार पर व्यापक सुनवाई की और शत्रुघ्न बबन मेश्राम मामले में सर्वोच्च अदालत के फैसले का जिक्र किया, जिसमें पिछले 40 वर्षों में उच्चतम न्यायालय के 67 फैसलों का विश्लेषण किया गया था.
इंडियन एक्सप्रेस के मुताबिक, जिसमें निचली अदालत या उच्च न्यायालय द्वारा धारा 376 (बलात्कार) और 302 (हत्या) अपराधों के लिए मौत की सजा दी गई थी और जहां पीड़ितों की उम्र 16 साल से कम थी.
शीर्ष अदालत की पीठ ने कहा कि ‘इन 67 मामलों में से इस अदालत ने 15 मामलों में अभियुक्तों को मौत की सजा देने की पुष्टि की.’
पीठ ने कहा, ‘उक्त 15 मामलों में से तीन में मौत की सजा को उम्रकैद की सजा में बदल दिया गया था. शेष 12 मामलों में से दो मामलों में (जहां समीक्षा याचिकाओं पर खुली अदालत में सुनवाई हुई थी) … मौत की सजा की पुष्टि की गई थी. इस प्रकार, आज की तारीख में 67 में से 12 मामलों में मौत की सजा की पुष्टि की गई है.’
अदालत ने कहा कि इन 67 मामलों में कम से कम 51 में पीड़ित 12 से कम उम्र के थे.
शीर्ष अदालत ने कहा, ‘उन 51 मामलों में से 12 में शुरू में मौत की सजा दी गई थी. हालांकि, तीन मामलों में मौत की सजा को उम्रकैद में बदल दिया गया था. उपरोक्त आंकड़ों से ऐसा प्रतीत होता है कि पीड़ित की कम उम्र को मौत की सजा लगाने के लिए इस न्यायालय द्वारा एकमात्र या पर्याप्त कारक नहीं माना गया है. अगर ऐसा होता, तो सभी 67 मामलों की परिणति अभियुक्तों को मौत की सजा देने में होती.’
