अपने ख़िलाफ़ यौन उत्पीड़न आरोपों की सुनवाई की पीठ का हिस्सा नहीं बनना चाहिए था: गोगाई
संवेदनशील अयोध्या भूमि विवाद मामले का पटाक्षेप करने का श्रेय पाने वाले देश के पूर्व प्रधान न्यायाधीश और राज्यसभा सांसद रंजन गोगोई ने बुधवार को कहा कि उन्हें, उनके खिलाफ यौन उत्पीड़न के आरोपों की सुनवाई करने वाली पीठ का हिस्सा नहीं होना चाहिए था.
उन्होंने कहा, ‘हम सभी गलती करते हैं और इसे स्वीकार करने में कोई बुराई नहीं है.’
अपनी आत्मकथा ‘जस्टिस फॉर द जज’ के विमोचन के मौके पर पूर्व प्रधान न्यायाधीश गोगोई ने विवादास्पद समेत सभी मुद्दों पर बात की. उन्होंने 46वें प्रधान न्यायाधीश के रूप में अपने कार्यकाल के दौरान राज्यसभा की सदस्यता के एवज में अयोध्या पर फैसला सुनाने संबंधी आरोपों को सिरे से खारिज किया.
बार एंड बेंच के अनुसार, गोगोई ने पुस्तक विमोचन कार्यक्रम के दौरान एक निजी टीवी चैनल से कहा, ‘मुझे उस पीठ में नहीं होना चाहिए था (जिसने उनके खिलाफ कथित यौन उत्पीड़न मामले की सुनवाई की थी). मैं इसलिए उस पीठ में था क्योंकि मेरी 45 साल की कड़ी मेहनत से बनी प्रतिष्ठा बर्बाद हो रही थी. मैं पीठ का हिस्सा नहीं होता, तो शायद अच्छा होता. हम सभी गलतियां करते हैं. इसे स्वीकार करने में कोई बुराई नहीं है.’
उल्लेखनीय है कि साल 2019 में उच्चतम न्यायालय की एक पूर्व कर्मचारी ने जस्टिस गोगोई पर यौन उत्पीड़न के आरोप लगाए थे, जिसका स्वत: संज्ञान लेते हुए उच्चतम न्यायालय ने जस्टिस गोगोई की अध्यक्षता में तीन न्यायाधीशों की पीठ गठित की थी.
अपनी पहचान जाहिर करने की अनिच्छुक सुप्रीम कोर्ट की पूर्व कर्मचारी का कहना था कि साल 2018 में सीजेआई गोगोई द्वारा उनका यौन उत्पीड़न किया गया था. इस घटना के कुछ हफ़्तों बाद ही उन्हें नौकरी से निकाल दिया गया.
जस्टिस गोगोई ने यौन उत्पीड़न के आरोपों से इनकार करते हुए कहा था कि यह ‘सीजेआई के कार्यालय को निष्क्रिय करने’ की ‘बड़ी साजिश’ का हिस्सा था.
अप्रैल 2019 में उन्होंने एक हलफनामे में अपना बयान दर्ज कर सर्वोच्च अदालत के 22 जजों को भेजा था, जिसके बाद एक आंतरिक जांच समिति का गठन किया था, जिसमें उस समय सुप्रीम कोर्ट के दूसरे वरिष्ठतम जज जस्टिस एसए बोबडे, जस्टिस इंदिरा बनर्जी और जस्टिस इंदु मल्होत्रा शामिल थे.
पीड़ित महिला ने मामले की सुनवाई शुरू होने के कुछ दिन बाद समिति के माहौल को डरावना बताते हुए समिति के समक्ष पेश होने से इनकार कर दिया था. शिकायतकर्ता ने अदालत में अपने वकील की मौजूदगी की अनुमति नहीं दिए जाने समेत अनेक आपत्तियां जताते हुए आगे समिति के समक्ष न पेश होने का फैसला किया था.
इसके बाद जस्टिस एसए बोबडे की अध्यक्षता वाली इस समिति ने यह कहते हुए कि ‘महिला के आरोपों में दम नहीं है’ गोगोई को क्लीन चिट दे दी थी.
समिति के इस निर्णय के बाद महिला ने प्रेस विज्ञप्ति जारी कर कहा था कि वे बेहद निराश और हताश हैं. देश की एक महिला के तौर पर उनके साथ घोर अन्याय हुआ है, साथ ही देश की सर्वोच्च अदालत से न्याय की उनकी उम्मीदें पूरी तरह खत्म हो गई हैं.
