नई दिल्ली: सुप्रीम कोर्ट में एक याचिका दायर कर न्यायालय और देश भर के उच्च न्यायालयों में वकीलों को गर्मियों के दौरान काला कोट और गाउन पहनने से छूट देने की मांग की गई है. याचिका में राज्य विधिज्ञ परिषदों को यह निर्देश देने का अनुरोध किया गया है कि वे नियमों में संशोधन करें और वह समयावधि निर्धारित करें, जब वकीलों को काला कोट और गाउन पहनने से छूट रहेगी. याचिका में कहा गया कि इस अवधि का निर्धारण उस राज्य विशेष में इस तथ्य से हो सकता है कि गर्मी वहां कब सबसे ज्यादा पड़ती है. यह याचिका वकील शैलेंद्र मणि त्रिपाठी ने दायर की है. याचिका में कहा गया कि भीषण गर्मी में कोट पहनकर एक अदालत से दूसरी अदालत जाना वकीलों के लिए काफी मुश्किल भरा होता है.याचिका में कहा गया है कि जब वकील जिला अदालतों, उच्च न्यायालयों और सुप्रीम कोर्ट के बीच यात्रा करते हैं, तो तेज गर्मी में काले वस्त्र पहनना असहनीय हो जाता है.

 

इसमें कहा गया है कि हमेशा कपड़े उतारना और उन्हें साथ ले जाना संभव नहीं है, क्योंकि महत्वपूर्ण फाइलें और अन्य सामान आमतौर पर वकीलों के हाथों में होते हैं. त्रिपाठी की याचिका में तर्क दिया गया है कि सुप्रीम कोर्ट और उच्च न्यायालयों में अभ्यास करने वाले सभी वकील इतने समृद्ध नहीं होते कि वे वातानुकूलित वाहन का खर्चा वहन कर सकें. गर्मियों में काले वस्त्र पहनने से गर्मी का प्रभाव बढ़ जाता है.

 

याचिका में यह भी कहा गया है कि असहज पोशाक पहनने से बेचैनी के कारण सही से काम करने में परेशानी होती है, क्योंकि गर्म मौसम में काले कोट और गाउन पहनकर अदालतों के परिसर में घूमना पड़ता है, जिससे निराशा और नाराजगी होती है, जो चिड़चिड़े आचरण को दर्शाता है.

 

अधिवक्ता अधिनियम, 1961 के तहत भारतीय विधिज्ञ परिषद के नियमों के तहत निर्धारित वकीलों के ड्रेसकोड के अनुसार अधिवक्ता के लिए सफेद शर्ट, काला कोट और सफेद नेकबैंड लगाना अनिवार्य है. नियमों के तहत वकील के हाईकोर्ट या सुप्रीम कोर्ट में पेश होने के दौरान को छोड़कर एडवोकेट का गाउन पहनना वैकल्पिक है.
