अदालतों में रिश्वतखोरी: सुप्रीम कोर्ट ने कहा- कोर्ट कर्मियों का घूस मांगना अस्वीकार्य, ऊँचे मानदंड सिर्फ जजों के लिए नहीं
सुप्रीम कोर्ट ने अदालतों में रिश्वतखोरी को लेकर सख्त टिप्पणी की है। शीर्ष कोर्ट ने कहा कि अदालतों में काम करते हुए रिश्वत मांगना अस्वीकार्य है। अदालतों में कामकाज के उच्च मानदंड सिर्फ जजों के लिए ही नहीं हैं, बल्कि वहां काम करने वाले कर्मचारियों के लिए भी हैं।
शीर्ष कोर्ट ने यह टिप्पणी बिहार की एक जिला कोर्ट में पदस्थ रहे व्यक्ति की सजा में परिवर्तन करते हुए की। एक केस में आरोपी को दोषमुक्त कराने के लिए 50 हजार रुपये की रिश्वत मांगने के आरोप में सेवा से बर्खास्त किया गया था। सुप्रीम कोर्ट से आग्रह किया गया था कि वह सजा में बदलाव कर बर्खास्तगी की बजाए निकालना कर दिया जाए, ताकि संबंधित व्यक्ति कहीं और नौकरी कर सके।
जस्टिस एएम खानविलकर व जस्टिस सीटी रविकुमार की पीठ से अपीलकर्ता के वकील ने कहा कि पिछले 24 सालों से इस व्यक्ति ने बेदाग सेवा की है और उसके खिलाफ यह पहला आरोप था। इस पर पीठ ने कहा, ‘तुम अदालत में काम करते हो और पैसा मांगते हो, अपीलकर्ता ने अपनी गलती मंजूर की है।’
शीर्ष अदालत पटना हाईकोर्ट की डबल बेंच के जनवरी 2020 के आदेश को चुनौती देने वाली याचिका पर सुनवाई कर रही थी। इस व्यक्ति ने पहले हाईकोर्ट की एकल पीठ में अपील की थी, जो खारिज हो गई थी। डबल बेंच ने भी उसकी अपील नामंजूर कर दी थी। एकल पीठ ने जनवरी 2018 में उस व्यक्ति की सजा में हस्तक्षेप से इनकार कर दिया था। यह व्यक्ति औरंगाबाद की कोर्ट में पीठासीन अधिकारी था।
सुनवाई के दौरान याचिकाकर्ता के वकील ने कहा कि फरियादी को 2014 में सेवा से बर्खास्त किया गया था। उसे सुनाई गई सजा बेहद सख्त है। इस पर सुप्रीम कोर्ट ने पूछा, ‘यह सजा सख्त कैसे है? यह जांच के बाद सुनाई गई है या नहीं?’ इस पर वकील ने कहा कि पहली जांच में जांच अधिकारी ने आरोपी को बरी कर दिया था। बाद में विभागीय जांच की गई और आरोप सही पाए गए।
