सुप्रीम कोर्ट: वकीलों के खिलाफ शिकायतों का एक वर्ष में हो निस्तारण, कहा-कानूनी शिष्टाचार बनाए रखना बार काउंसिल ऑफ इंडिया का कर्तव्य
सुप्रीम कोर्ट ने बार काउंसिल ऑफ इंडिया (बीसीआई) को आदेश दिया है कि देश में वकीलों के खिलाफ दायर शिकायतों का निस्तारण अधिवक्ता अधिनियम की धारा 35 के तहत एक साल के भीतर तेजी से करें, जैसा कि धारा 36 बी के मुताबिक यह किया जाना अनिवार्य है। जस्टिस एमआर शाह व जस्टिस बीवी नगरत्ना की खंडपीठ ने शुक्रवार को बीसीआई को दिए आदेश में सभी राज्यों की बार काउंसिल को निर्देशित करने को कहा है।
अदालत ने कहा, बीसीआई भी उसे सौंपी गई शिकायतों को एक वर्ष की अवधि में निस्तारित करे। इसके अलावा केवल असाधारण मामलों में वैध कारण के आधार पर ही राज्य बार काउंसिल किसी मामले को बीसीआई को सौंपें। पीठ ने कहा कि बीते पांच वर्ष में 1273 शिकायतें बीसीआई को सौंपी गई थीं। बीसीआई को शिकायतों के निपटारे के लिए सेवानिवृत्त जजों की मदद लेने पर विचार करना चाहिए।
पीठ ने बीसीआई की तरफ से कोविड महामारी के कारण शिकायतों का निपटारे में देरी की दलील को खारिज करते हुए कहा कि यह राज्य बार काउंसिल और बीसीआई का कर्तव्य है कि एक वकील के रूप में नामांकित व्यक्ति अपने पद का दुरुपयोग न करे। बीसीआई को हर हाल में कानूनी पेशे के मानक और शिष्टाचार को बनाए रखना चाहिए।
पीठ ने कहा कि निर्धारित समय के भीतर शिकायतों का निपटारा नहीं कर पाना अधिवक्ता अधिनियम के तहत तय कर्तव्यों को निभाने में विफलता के समान है।
