नई दिल्लीः सुप्रीम कोर्ट ने शुक्रवार को कहा कि देश में कोरोना वायरस के मद्देनजर जेलों से भीड़ को कम करने लिए रिहा किए गए कैदियों को आत्मसमर्पण के लिए नहीं कहा जाना चाहिए. चीफ जस्टिस एनवी रमना, जस्टिस नागेश्वर राव और जस्टिस एएस बोपन्ना की पीठ ने राज्य सरकारों को 23 जुलाई तक रिपोर्ट पेश करने का निर्देश दिया है, जिसमें पूरा ब्योरा हो कि कैदियों की रिहाई के लिए उन्होंने किन मानदंडों का पालन किया था. बता दें कि अदालत ने कोरोना के मद्देनजर जेलों की भीड़-भाड़ कम करने के लिए स्वत: संज्ञान लिए गए मामले की सुनवाई के दौरान यह बात कही.

सुप्रीम कोर्ट ने सात मई को कोरोना के मामले में अप्रत्याशित बढ़ोतरी पर संज्ञान लेते हुए राज्य सरकारों से उन कैदियों को तुरंत रिहा करने के लिए कहा था, जिन्हें पिछले साल जमानत या पैरोल दी गई थी. इसके साथ ही जेलों से भीड़ को कम करने की प्रक्रिया पर निगरानी रखने के लिए राज्यवार उच्चाधिकार प्राप्त समितियों (एचपीसी) का गठन किया था. सुप्रीम कोर्ट ने इसे कैदियों और पुलिसकर्मियों के जीवन के अधिकार से संबंधित मामला बताते हुए लगभग चार लाख कैदियों वाली आवासीय जेलों से भीड़ को कम करने की मंजूरी दी थी.

अदालत ने यह आशंका जताई थी कि ये जेल कोविड-19 हॉटस्पॉट बन सकती हैं. सुप्रीम कोर्ट ने शुक्रवार के अपने आदेश में कहा कि कैदियों की रिहाई के लिए राज्यों एवं केंद्रशासित प्रदेशों में समान मानदंडों का पालन नहीं किया गया. उन्होंने राज्य सरकारों से उम्र, कई बीमारियां होने जैसे कारकों की व्याख्या करने को कहा, जिनका उन्होंने पैरोल देने के समय पालन किया था. राज्य सरकारों से यह भी बताने को कहा है कि जिन कैदियों की अपील उच्च अदालतों में लंबित हैं, क्या एचपीसी द्वारा उनकी भी रिहाई पर विचार करना चाहिए.

इसके अलावा अदालत ने राष्ट्रीय विधिक सेवा प्राधिकरण के सचिव को राज्यों से पूरा ब्योरा इकट्ठा करने का निर्देश दिया है. मामले की अगली सुनवाई तीन अगस्त को होगी.
