20 साल बाद मिली सजा: फर्जी रूप से परीक्षा दे रहे महिला आरोपी सहित अन्य दो को 1-1 वर्ष का सश्रम कारावास
ग्वालियर। न्यायालय महेन्द्र कुमार सैनी अति. मुख्य न्यायिक मजिस्ट्रेट ग्वालियर द्वारा आरोपी अनिल कुमार यादव , अनिल कुमार चौधरी व श्रीमती सविता यादव को भा.दं.सं. की धारा 471 के अधीन दोषसिद्ध करते हुये 1-1 वर्ष का सश्रम कारावास एवं 2000-2000 रूपये के अर्थदण्ढ से दण्डित किया।
अभियोजन की ओर से पैरवी करने वाले सहायक जिला लोक अभियोजन अधिकारी अभिषेक सिरौठिया ने घटना के बारे मे बताया कि 26 मार्च 2001 को फरियादी रविन्द्र नाथ श्रीवास्तव ने रिपोर्ट लेख कराई कि उसके पैनल द्वारा शासकीय उच्चतर माध्यमिक विद्यालय जनकगंज ग्वालियर केन्द्र क्रमांक 14013 पर सुबह बजे निरीक्षण किया गया व उसके द्वारा केन्द्राध्यक्ष एवं उक्त विद्यालय के प्राचार्य द्वारा परीक्षार्थियों के फोटो व हस्ताक्षर मिलान कराये इस संबंध मे सूचना प्राप्त हुई कि राजस्थान के कुछ छात्र म.प्र. के फर्जी मूलनिवासी बनकर हाईस्कूल प्रमाण पत्र की परीक्षा 2001 दे रहे है।
अभिलेखों में मिलान करने पर कक्षा 8 कक्षा 9 की अंकसूचियों की विस्तृत जॉच की गई जिनमे तीन छात्र छात्राए अनिल कुमार यादव , अनिल कुमार चौधरी व सविता यादव के अभिलेख संदिग्ध पाये गये छात्रो से पूछताछ करने पर उन्होने रूपेश शर्मा निवासी अलबर से फोर्म भरवाया जाना बताया तथा अनिल कुमार यादव 15000 रूपये अनिल कुमार चौधरी द्वारा 13500 रूपये व सविता यादव द्वारा 15000 रूपये रूपेश शर्मा को अलवर में दिया जाना बताया ।
साथ ही छात्रों ने बताया कि रूपेश शर्मा ने तीनों छात्रों को प्रवेश पत्र देने व परीक्षा में 50 से 55 प्रतिशत अंक दिलाने की गारंटी दी ।छात्रों ने बताया था कि वह रूपेश शर्मा के साथ वर्ष 2001 में 30 व 40 लडकों व 3 लडकियों को लेकर जयेन्द्रगंज स्थित धर्मशाला में रूका था साथ ही तीनों परीक्षार्थियों ने बताया कि उन्होंने रिचा हाई स्कूल आमखों कम्पू कभी नही देखा विवेचना के दौरान तीनों आरोपीगण के विरूद्ध अपराध सिद्ध पाया गया।
जिसका अभियोग पत्र माननीय न्यायालय के समक्ष प्रस्तुत किया गया, जिसका विचारण लगभग 20 वर्षो से लंबित था।
विचारण के दौरान आयी साक्ष्य एवं अभियोजन अधिकारी के तर्को से सहमत होते हुये न्यायालय द्वारा आरोपीगण को दोषसिद्ध पाया, जिस पर माननीय न्यायालय द्वारा अपराध की गंभीरता, प्रकृति एवं प्रकरण की परिस्थितियों को देखते हुये अभियुक्तगण को भारतीय दण्ड संहिता की धारा 471 के अधीन दोषसिद्ध करते हुये 1-1 वर्ष का सश्रम कारावास एवं 2-2 हज़ार रूपये के अर्थदण्ढ से दण्डित किया।
