सुप्रीम कोर्ट ने कहा : अब थप्पड़ मारकर ‘सॉरी’ बोलने की प्रथा खत्म होनी चाहिए

सुप्रीम कोर्ट ने मंगलवार को कहा, अब बहुत हो चुका, थप्पड़ मारकर सॉरी बोलने की प्रथा खत्म करनी होगी। इस टिप्पणी के साथ ही शीर्ष अदालत ने उत्तराखंड हाईकोर्ट पर अवमाननापूर्ण आरोप वाली याचिका खारिज करते हुए याचिकाकर्ता विजय सिंह पाल पर 25 लाख का जुर्माना भी लगाया। जो उसे चार हफ्ते में कोर्ट की रजिस्ट्री में जमा कराना होगा।

ऐसा नहीं करने पर उसकी संपत्ति से भू-राजस्व के बकाया के रूप में राशि की वसूली की जाएगी। जस्टिस एएम खानविलकर और जस्टिस सीटी रविकुमार की पीठ ने आदेश में कहा, आवेदन में किए गए कथन अस्वीकार्य हैं। आवेदक द्वारा पूरे उत्तराखंड हाईकोर्ट और राज्य सरकार के अधिकारियों पर आरोप लगाने का दुस्साहस किया गया।

हमारे विचार में एक आवेदक जो खुद को उस मामले में हस्तक्षेपकर्ता बनाना चाहता है जिसमें जटिल मुद्दे शामिल हैं। उसे कुछ संयम दिखाना चाहिए और निराधार आरोप लगाने से बचना चाहिए। पीठ ने हरिद्वार के जिला कलेक्टर को चार सप्ताह में पाल से वसूली के आदेश का पालन करने का निर्देश दिया है।

याचिका में पाल ने दावा किया था कि वह कई राज्यों में संपत्तियों का प्रबंधन करने वाले तत्कालीन होल्कर शाही परिवार के इंदौर स्थित ट्रस्ट द्वारा संपत्तियों की बिक्री और हस्तांतरण के कथित घोटाले का व्हिसल ब्लोअर था। उसने उत्तराखंड हाईकोर्ट के न्यायाधीशों, उत्तराखंड सरकार के अधिकारियों के साथ-साथ सॉलिसिटर जनरल तुषार मेहता पर इस मामले में निष्पक्ष रूप से कार्रवाई नहीं करने का आरोप लगाया।

मेहता मामले में मध्य प्रदेश सरकार की ओर से पेश हुए। अक्तूबर 2020 में मध्य प्रदेश हाईकोर्ट ने खासगी (देवी अहिल्याबाई होल्कर चैरिटीज) ट्रस्ट द्वारा संपत्तियों की बिक्री और हस्तांतरण को शून्य करार दिया था और आर्थिक अपराध शाखा को इसकी जांच करने का आदेश दिया था। हाईकोर्ट ने इंदौर स्थित ट्रस्ट द्वारा प्रबंधित संपत्तियों को राज्य सरकार के पास रखने का भी फैसला सुनाया था।

इधर, सुप्रीम कोर्ट ने मंगलवार को कहा कि एनजीओ के उस आवेदन पर तीन सदस्यीय पीठ विचार करेगी, जिसमें 25 लाख रुपये के जुर्माने को दान मानने का अनुरोध किया था। दरअसल सुप्रीम कोर्ट ने मेडिकल कॉलेज घोटाले में कथित घूसखोरी की एसआईटी से जांच की मांग को खारिज करते हुए एनजीओ पर 25 लाख रुपये जुर्माना लगाया था।

सुप्रीम कोर्ट ने दिसंबर, 2017 को कैंपेन फॉर ज्यूडीशियल अकाउंटिबिलिटी एंड रिफॉर्म्स की याचिका को अवमानना योग्य करार देते हुए एनजीओ को सुप्रीम कोर्ट की रजिस्ट्री में छह हफ्ते में 25 लाख जमा करवाने का निर्देश दिया था।

कोर्ट ने कहा था कि इस राशि को सुप्रीम कोर्ट बार एसोसिएशन के अधिवक्ता कल्याण कोष में जमा करवाया जाएगा। जस्टिस एएम खानविलकर व जस्टिस सीटी रविकुमार ने कहा कि 2017 के सुप्रीम कोर्ट के आदेश को तीन जजों की पीठ ने पारित किया था और यह उपयुक्त होगा कि एनजीओ के निवेदन पर उस फैसले पर तीन जजों की पीठ विचार करे।
