उच्च न्यायालयों में लागू हो समान संहिता, सुप्रीम कोर्ट में याचिका दायर
उच्च न्यायालयों में यूनिफार्म ज्यूडिशियल कोड लागू करने को लेकर सुप्रीम कोर्ट में याचिका दायर की गई है। याचिका के तहत सुप्रीम कोर्ट से मांग की गई है कि उच्च न्यायालयों को यह निर्देश दिया जाए कि मामलों का पंजीकरण करने और समान न्यायिक शब्दावली, व्याक्यांशों एवं संक्षिप्त शब्दों के उपयोग के लिए एक समान संहिता अपनाई जाए।
अधिवक्ता अश्विनी कुमार उपाध्याय की ओर से दायर की गई याचिका में यह भी मांग की गई है कि वह विधि आयोग को भी निर्देश दे कि न्यायिक शब्दावली, वाक्यांशों, संक्षिप्त शब्दों, मामला दर्ज करने की प्रक्रिया और अदालत के शुल्क में एकरूपता सुनिश्चित करने के लिए उच्च न्यायालयों के साथ विचार-विमर्श करके एक रिपोर्ट तैयार करे।
याचिका में कहा गया है कि विभिन्न उच्च न्यायालयों द्वारा विभिन्न प्रकार के मामलों के लिए इस्तेमाल की जाने वाली शब्दावली एक समान नहीं है। यह गैर-एकरूपता न केवल आम जनता के लिए बल्कि कई मामलों में अधिवक्ताओं और अधिकारियों के लिए भी असुविधा का कारण बनती है।
एक ही प्रकार के मामलों को संदर्भित करने के लिए उच्च न्यायलयों द्वारा प्रयोग किए जाने वाले केवल शब्द ही अलग नहीं हैं, बल्कि इन शब्दों को संदर्भित करने के लिए उपयोग किए जाने वाले संक्षिप्त शब्द भी अलग-अलग हैं।
अश्विनी कुमार उपाध्याय ने कहा कि देश भर के सभी 25 उच्च न्यायालयों में अलग-अलग मामलों की पहचान करने के लिए अलग-अलग वाक्यांशों का उपयोग किया जाता है।
