दहेज केस: पति के परिजनों को आरोपी बनाने की प्रवृत्ति पर सुप्रीम कोर्ट ने जताई चिंता, हाईकोर्ट का फैसला पलटा

सुप्रीम कोर्ट ने दहेज प्रताड़ना के एक मामले में इलाहाबाद हाईकोर्ट के आदेश को पलटते हुए एक पुरुष व एक महिला के खिलाफ आपराधिक कार्यवाही को रद्द कर दिया। इसके साथ ही शीर्ष कोर्ट ने फिर कहा कि एफआईआर में आकस्मिक रूप से नाम जोड़कर पति के परिजनों को वैवाहिक विवादों में आरोपी बनाने की प्रवृत्ति जारी है।

जस्टिस आर. सुभाष रेड्डी और जस्टिस ऋषिकेश रॉय की पीठ ने इलाहाबाद हाईकोर्ट का वह आदेश खारिज कर दिया, जिसमें मृतका के देवर या जेठ व सास को दहेज मृत्यु के केस में सरेंडर करने और जमानत अर्जी दायर करने का आदेश दिया गया था।

शीर्ष कोर्ट ने संबंधित मामले पर दिए आदेश में कहा कि एफआईआर में बड़ी संख्या में पति के परिवार के सदस्यों के नामों का लापरवाही से उल्लेख किया गया है, जबकि केस की विषय वस्तु अपराध में उनकी सक्रिय भागीदारी का खुलासा नहीं करती है। ऐसे में उन परिजनों के खिलाफ संज्ञान लेना न्यायोचित नहीं है। कोर्ट ने यह भी कहा कि ऐसे मामलों में संज्ञान लेने से न्यायिक प्रक्रिया का दुरुपयोग होता है।

शीर्ष कोर्ट ने कहा कि मृतका के पिता द्वारा दर्ज कराई गई शिकायत के आधार पर देवर व सास के भी खिलाफ अपराध दर्ज किया गया था, लेकिन उनकी भूमिका का कोई खास खुलासा नहीं किया गया था। दूसरे प्रतिवादी यानी मृतका के पिता के पुलिस द्वारा दर्ज बयान व अंतिम जांच रिपोर्ट में भी अस्पष्ट आरोपों के अलावा अपीलकर्ताओं की अपराध में लिप्तता साबित करने के कोई खास आरोप नहीं हैं।

सुप्रीम कोर्ट ने अपने इस हालिया आदेश में कहा कि इस अदालत ने वैवाहिक विवादों में बार-बार पति के परिवार के सदस्यों को आकस्मिक संदर्भ देकर आरोपी बनाने पर संज्ञान लिया है।  मृतका के पिता ने 25 जुलाई 2018 को गोरखपुर के कोतवाली थाने में शिकायत दर्ज कराई थी कि उनकी छोटी बेटी का पति, देवर, जेठ और सास लगातार चार पहिया वाहन की मांग करते हैं और दहेज के रूप में 10 लाख रुपये नकद मांगते थे। यह भी आरोप लगाया गया कि मांग पूरी नहीं की गई तो वे बेटी को मारते थे और जान से मारने की धमकी देते थे। 24 जुलाई 2018 को रात करीब 8 बजे आरोपियों ने एकमत होकर उनकी बेटी को मार कर फांसी पर लटका दिया था।
