सुप्रीम कोर्ट ने गुजरात में रेलवे की उस जमीन पर अतिक्रमण करने वालों के खिलाफ कार्रवाई नहीं करने के लिए सोमवार को रेलवे की खिंचाई की, जहां एक रेल लाइन का निर्माण होना है। शीर्ष अदालत ने कहा कि अतिक्रमण करने वालों के खिलाफ कार्रवाई शुरू करना रेलवे का ”वैधानिक दायित्व” है। शीर्ष अदालत ने कहा कि ”सार्वजनिक परियोजना” को आगे बढ़ाना है और प्राधिकारियों को इस पर कार्रवाई करनी चाहिए थी।

न्यायमूर्ति ए एम खानविलकर और न्यायमूर्ति सी टी रविकुमार की पीठ ने कहा, ”परियोजना को आगे बढ़ाना है। यह एक सार्वजनिक परियोजना है। आप अपनी योजनाओं और बजट व्यवस्था का मजाक बना रहे हैं। जो अतिक्रमण कर रहे हैं उन्हें हटायें। हटाने के लिए कानून है।

आप उस कानून का प्रयोग नहीं कर रहे हैं।” पीठ ने रेलवे की ओर से पेश हुए अतिरिक्त सॉलिसिटर जनरल (एएसजी) के एम नटराज से कहा, ”यह आपकी संपत्ति है और आप अपनी संपत्ति की रक्षा नहीं कर रहे हैं। अतिक्रमण करने वालों के खिलाफ कार्रवाई शुरू करना आपका एक वैधानिक दायित्व है।”

शीर्ष अदालत दो अलग-अलग याचिकाओं पर सुनवाई कर रही थी, जिसमें गुजरात और हरियाणा में रेलवे की जमीनों से अतिक्रमण हटाने से संबंधित मुद्दे उठाए गए हैं।

गुजरात के मामले में, याचिकाकर्ताओं ने पहले शीर्ष अदालत को बताया था कि गुजरात उच्च न्यायालय ने यथास्थिति बनाये रखने का अपना अंतरिम आदेश वापस ले लिया था और पश्चिम रेलवे को सूरत-उधना से जलगांव तक की तीसरी रेल लाइन परियोजना पर आगे बढ़ने की अनुमति दी थी।

उच्च न्यायालय के आदेश के बाद, याचिकाकर्ताओं ने शीर्ष अदालत का रुख किया जिसने गुजरात में इन ‘झुग्गियों’ के ध्वस्तीकरण पर यथास्थिति प्रदान की थी।
