ग्वालियर।आरती शर्मा विशेष न्यायाधीश, लैंगिक अपराधों से बालकों का संरक्षण अधिनियम, ग्वालियर ने नाबालिग के साथ बलात्कार के आरोपी चंदू उर्फ चंद्रभान उर्फ आदित्य पुत्र रंजीत सिंह भदौरिया को धारा 366 भादवि में 5 वर्ष सश्रम कारावास एवं धारा 376 भादवि में 7 वर्ष सश्रम कारावास की सजा एवं 2000 रूपये का जुर्माना, आरोपी शिवा उर्फ शिवनंदन पु्त्र विश्राम सिंह भदौरिया उम्र 27 वर्ष निवासी सदर, आरोपी मनीष सिंह सोलंकी पुत्र भारत सिंह सोलंकी उम्र 27 वर्ष निवासी चरखा, थाना भितरवार को धारा 376डी में दोषीपाते हुये 20 वर्ष का सश्रम कारावास एवं 2000-2000 रूपये का जुर्माना, की सजा सुनाई ।
अभियोजन की और से पैरवी करने वाले विशेष लोक अभियोजक अनिल मिश्रा ने घटना के बारे में बताया कि अभियोक्त्री अपने ग्राम में अपने माता पिता के साथ रहकर किसानी का कार्य करती थी।
प्रथम सूचना रिपोर्ट से करीब 5 माह पहले उसकी पहचान अभियुक्त चंदू से हुई थी, अभियुक्त चंदू भी वही काम करता था और काम से वह फरियादिया के गाँव आता रहता था। आरोपी चंदू की फोन पर बात होती रहती थी, घटना दिनांक 23 जनवरी2014 को अभियोक्त्री आमला से सदन ट्रेन से अभियुक्त से मिलने ग्वालियर गई थी।
रात 11 बजे ट्रेन ग्वालियर पहुच गई थी, आरोपी चंदू अपने दोस्त सहआरोपी सोनू के साथ ग्वालियर रेल्वे स्टेशन लेने आये, आरोपी चंदू और सोनू ऑटो से महलगॉव करोली माता मंदिर के पास आरोपी सोनू के कमरे पर ले गये थे।
आरोपी चंदू ने उसी रात 11:30 बजे फरियादिया के साथ जबरन बलात्कार किया। दूसरे दिन अभी आ रहा हॅू कह कर चला गया, जिसके वाद वह वापिस नही आया दो दिन तक अभियोक्त्री सोनू के कमरे पर रूककर चंदू का इंतजार किया लेकिन वह नही आया चंदू ने अपना मोबाइल भी बंद कर लिया था दिनांक 25/01/2014 की शाम को अभियुक्त ने फोन कर कहा कि शिवा ओर मनीष सोनू के कमरे पर आ रहे है।
वे तुम्हे स्टेशन छोड देगे, तू आमला चली जाना में 8 दिन बाद तुमसे मिलने आउगा और तुमसे शादी कर लूंगा थोडी देर बाद शिवा ओर मनीष आये रात करीब 8 बजे अभियोक्त्री व आरोपी मनीष व शिवा के साथ पैदल स्टेशन के लिए चल दी।
थोडी दूर पैदल चलने के बाद फरियादिया से कहा कि अभी पैसे का जुगाड नही है, थोडी देर मे पैसे आ जायेगे तो तुझे टिकट दिलाकर स्टेशन छोड देगे, तब तक इस बस में बैठते है, अभियुक्त शिवा व मनीष अभियोक्त्री को उक्त बस के अंदर चले गये। बस में ले जाने के बाद अभियुक्त शिवा व मनीष ने बारी-बारी से जबरन बलात्कार किया अभियोक्त्री चिल्लाने को हुई तो अभियुक्त मनीष व शिवा ने उसे लात-थप्पड से मारा और कहा कि चिल्लाई तो जान से मार देगे।
अभियोक्त्री डर गई रात भर अभियुक्तगण मनीष व शिवा ने उसे बस मे रखा और दूसरे दिन दिनांक 26/01/2014 को आरोपीगण ने उसे स्टेशन छोड दिया उसी दिन रात को वह आमला आ गई उससे सारी बात अपने माता पिता व भाई को बताई और उनके साथ थाने जाकर रिपोर्ट पंजीवद्ध कराई ।
जिस पर से पुलिस थाना विश्वविद्वालय के अपराध विवेचना में लिया विवेचना के दौरान अभियोग पत्र मानननीय विशेष न्यायालय के समक्ष प्रस्तुत किया। माननीय न्यायालय ने अभियेाजन के तर्को से सहमत होकर आरोपीगण को सजा सुनाई ।
