पटाखों में ज़हरीले रसायनों के इस्तेमाल पर सीबीआई की रिपोर्ट बेहद गंभीर: सुको
नई दिल्ली: उच्चतम न्यायालय ने बुधवार को कहा कि पटाखों के निर्माण में जहरीले रसायनों के इस्तेमाल पर सीबीआई की रिपोर्ट बहुत गंभीर है और प्रथमदृष्टया बेरियम के इस्तेमाल और पटाखों पर लेबल लगाने को लेकर अदालत के आदेशों का उल्लंघन किया गया है. जस्टिस एमआर शाह और जस्टिस एएस बोपन्ना की पीठ ने कहा कि सीबीआई द्वारा जब्त किए गए पटाखों में बेरियम सॉल्ट जैसे हानिकारक रसायन पाए हैं.
न्यायालय ने कहा कि हिंदुस्तान फायरवर्क्स और स्टैंडर्ड फायरवर्क्स जैसे पटाखा निर्माताओं ने भारी मात्रा में बेरियम खरीदा और पटाखों में इन रसायनों का इस्तेमाल किया.
शीर्ष अदालत ने पिछले साल तीन मार्च को कहा था कि स्टैंडर्ड फायरवर्क्स, हिंदुस्तान फायरवर्क्स, विनायगा फायरवर्क्स इंडस्ट्रीज, श्री मरिअम्मन फायरवर्क्स, श्री सूर्यकला फायरवर्क्स और सेल्वा विनयगर फायरवर्क्स को कारण बताने के लिए निर्देशित किया गया था कि उन्हें प्रतिबंधित रसायनों के उपयोग के लिए आदेशों के उल्लंघन को लेकर अवमानना के वास्ते दंडित क्यों न किया जाए.
पीठ ने कहा, ‘सीबीआई द्वारा सौंपी गई रिपोर्ट पर विचार करते हुए प्रथम दृष्टया ऐसा प्रतीत होता है कि उन्होंने शीर्ष अदालत और बेरियम सॉल्ट के बारे में पहले दिए गए आदेशों और पटाखों पर लेबल लगाने के आदेशों का उल्लंघन किया है.’
पीठ ने हालांकि कहा, ‘पटाखा निर्माताओं को अपना मामला आगे बढ़ाने और उन्हें सीबीआई की रिपोर्ट देने का एक और मौका देने के लिए हम अतिरिक्त सॉलिसिटर जनरल ऐश्वर्य भाटी को निर्देश देते हैं कि वे निर्माताओं की तरफ से पेश होने वाले संबंधित वकीलों को जांच रिपोर्ट की एक प्रति कल (गुरुवार) तक प्रस्तुत करें. रिपोर्ट की प्रति याचिकाकर्ता के वकील को भी प्रस्तुत की जाए.’
पीठ ने सीबीआई, चेन्नई के संयुक्त निदेशक की रिपोर्ट के संबंध में अपना मामला रखने के लिए निर्माताओं को एक और मौका दिया तथा निर्देश दिया कि सीबीआई की प्रारंभिक जांच रिपोर्ट की एक प्रति बृहस्पतिवार तक सभी संबंधित वकीलों को मुहैया करायी जाए.
न्यायालय ने कहा कि हर दिन देश में जश्न होता है, लेकिन उसे दूसरे पहलुओं पर भी गौर करना होगा और वह लोगों को मरने के लिए नहीं छोड़ सकता. लोग अस्थमा और अन्य बीमारियों से पीड़ित हैं, बच्चे भी पीड़ित हो रहे हैं.
इस मामले पर अगली सुनवाई छह अक्टूबर को होगी.
