लिव इन दंपति में से एक विवाहित हो, तो सुरक्षा नहीं मिलेगी: इलाहाबाद हाईकोर्ट
प्रयागराज। इलाहाबाद उच्च न्यायालय ने एक मामले में शुक्रवार को कहा कि वह लिव-इन संबंध के खिलाफ नहीं है, लेकिन जब लिव इन संबंध में रह रही दंपति में से एक व्यक्ति शादीशुदा हो तो वह सुरक्षा नहीं दे सकता. अदालत ने यह टिप्पणी उन याचिकाकर्ताओं को पुलिस सुरक्षा प्रदान करते हुए की, जो विवाह योग्य थे और साथ रहना चाहते थे और बाद में उन्होंने विवाह कर लिया.
उत्तर प्रदेश के बदायूं जिले की इस दंपति की रिट याचिका आंशिक रूप से स्वीकार करते हुए जस्टिस कौशल जयेंद्र ठाकर और जस्टिस दिनेश पाठक की खंडपीठ ने कहा, हम लिव इन संबंध के खिलाफ नहीं हैं. इससे पूर्व, हमने लिव इन संबंध में रहने के इच्छुक एक दंपति की पुलिस सुरक्षा की मांग वाली याचिका खारिज कर दी थी. इसका कारण यह था कि उन याचिकाकर्ताओं में से एक व्यक्ति पहले से विवाहित था.
मौजूदा मामले में अदालत को बताया गया कि इस रिट याचिका के लंबित रहने के दौरान दंपति ने आर्य समाज मंदिर में विवाह कर लिया है. उन्होंने इस आशंका को लेकर अदालत का रुख किया है कि उनके परिजनों द्वारा उनका उत्पीडऩ किया जा सकता है. याचिकाकर्ताओं को सुरक्षा उपलब्ध कराने का पुलिस को निर्देश देते हुए अदालत ने कहा कि इस मामले में दोनों याचिकाकर्ता विवाह योग्य हैं और वे लिव इन संबंध में रहना चाहते थे, लेकिन बाद में उन्होंने विवाह कर लिया. इसलिए ज्ञान देवी बनाम नारी निकेतन अधीक्षक, दिल्ली और इसी तरह के अन्य मामलों में उच्चतम न्यायालय के निर्णयों को देखते हुए ये याचिकाकर्ता सुरक्षा के पात्र हैं.
उल्लेखनीय है कि इस अदालत ने 15 जून, 2021 को लिव-इन संबंध में रह रहे एक दंपति की सुरक्षा की मांग वाली याचिका यह कहते हुए खारिज कर दी थी कि महिला पहले से शादीशुदा हैं और एक दूसरे पुरुष के साथ लिव इन संबंध में रह रही हैं.
