ज्वाला शक्ति संगठन व संघर्ष समूह ने पीडि़त को न्याय के लिए दिया सहयोग, उच्च न्यायालय से दिलवाई राहत
एटा/ग्वालियर। कहते हैं एक पुरुष पर जब महिला अत्याचार का आरोप मात्र लगाए तो महिला के लिए समाज, पुलिस व मीडिया एकतरफा उस पुरुष को ही दोषी ठहराने कि प्रक्रिया शुरू कर देते हैं, ऐसे में कोई दिमाग से अपराधी महिला यदि ऐसा करे तो उस पुरुष की मदद करना तो दूर लोग उसके साथ दोयम दर्जे का व्यवहार कर उसे सजा देने की मांग बिना कोर्ट के निर्णय के कर देते हैं। उत्तर प्रदेश के एटा में एक ऐसा ही मामला सामने आया है जिसमें रेप कि शिकायत के मामले में मुख्य आरोपी के बयान पुलिस थाने पर उच्च न्यायालय के आदेश पर दर्ज किए गए हैं। वहीं उसे जमानत भी मिली है।

वर्ष 2019 में थाना रिजोर जिला एटा उप्र में एक परिवार ने अपनी बालिग लड़की के गुमशुदा होने पर एफआईआर दर्ज करवाई। पुलिस जांच शुरू करती है तो कुछ दिन बाद उक्त युवती स्वयं पुलिस के पास हाजिर होकर कहती है कि वह अपनी मौसी के यहां रहने गई थी, चूंकि उसने कहा कि वह बालिग है और अपनी मर्जी की स्वयं मालिक है। कोर्ट में बयान देने के बाद युवती को अपनी पसंद की जगह पर जाने की अनुमति कोर्ट द्वारा दी जाती है और थाना रिजोर न्यायालय में लड़की के कथन के आधार पर खात्मा रिपोर्ट न्यायालय में प्रस्तुत कर देती है। अब कहानी में नया मोड़ तब आता है जब युवती करीबन 9 माह बाद कानपुर के एसपी के सामने उपस्थित होती है और अपमे पुराने बयानों से हट कर घटना के समय, लॉकडाउन के दौरान स्वयं का अपहरण होना, जबर्दस्ती गर्भपात किए जाना एवं तेजाब फेंकने की शिकायत की कहानी सुनाती है और एक परिवार के सभी सदस्यों के विरुद्ध अपने लिए न्याय की पुरजोर मांग करती है। विवेचना शुरू होने के बाद परिवार के एक युवक को गिरफ्तार किया जाता है और जेल भेज दिया जाता है । पुलिस भी आये दिन परिवारजनों को प्रताडि़त करना शुरू कर देती है।

इस बीच मुख्य आरोपी ने ज्वाला शक्ति संगठन की संयोजिका काजल जादौन से संपर्क किया और शिकायत वापस लेने के लिए 18 लाख रुपए की मांग के बारे में बताया जाता है जिसपर शातिर युवती और उसके साथियों को एक्सपोज करने के लिए एक स्टिंग ऑपरेशन किया जाता है। शिकायत करने वाली युवती के कहे अनुसार रुपए देने के लिए काजल एटा शहर जाती हैं। खास बात यह है कि इस बारे में पुलिस के वरिष्ठ अधिकारियों को भी पहले से ही अवगत करा दिया जाता है। स्पॉट पर ब्लैकमेल करने वाली महिला रुपए लेने के लिए अपने साथ दो पुरुष मित्रों के साथ आती है और सबूत के लिए घटना की वीडियो रिकॉर्डिंग संगठन के द्वारा बनाई जाती है, लेकिन महिला पैसों से भरा बैग अपने साथी को देकर बाद में भागने में सफल हो जाती है। इसके सभी साक्ष्य स्थानीय थाना कोतवाली नगर एटा में संगठन के द्वारा दिए जाते हैं तो पुलिस द्वारा लापरवाही की जाती है परन्तु संगठन व स्थानीय पत्रकारों कि उपस्थिति के चलते पुलिस युवती के विरुद्ध दर्ज करने को मजबूर होती है।

संगठन कोर्ट में प्रस्तुत करता है वाद
पुलिस की लापरवाही को उजागर करने के लिए और शातिर महिला को एक्सपोज करने के लिए ज्वाला शक्ति संगठन चुप नहीं बैठता है। संगठन के द्वारा संघर्ष समूह के साथ क़ानूनी कार्यवाही क्रियान्वित कर एक याचिका स्थानीय न्यायालय में व समस्त घटना चक्र को लेकर एक याचिका उच्च न्यायालय इलाहाबाद हाई कोर्ट में प्रस्तुत की जाती है जिसमें समस्त घटना से संबंधित रिकॉर्ड न्यायालय के समक्ष प्रस्तुत किए जाते हैं। समस्त साक्ष्यों के अवलोकन उपरांत उच्च न्यायालय के द्वारा मुख्य आरोपी संदीप सिंह यादव को अग्रिम जमानत का लाभ दिया जाता है। वहीं घटना से संबंधित बयान स्थानीय थाने में देने के आदेश दिए जाते हैं जिसके चलते मुख्य आरोपी के द्वारा पुलिस थाना रिजोर में थाना प्रभारी के समक्ष बयान दर्ज किए गए।

उपरोक्त मामले में धन उगाही के उद्देश्य से ही संदीप के खिलाफ प्रकरण महिला के द्वारा पंजीबद्ध करवाया गया था, जबकि पूर्व में खुद उसके द्वारा ही किसी भी प्रकार के अपहरण या गुमशुदा होने से इनकार किया गया था। महिला किसी और के साथ रहती थी व उसके द्वारा जो पैसा संदीप से पूर्व में लिया था मांगने पर यह काम किया गया । युवती के दोनों बार न्यायालयीन कथनों में भिन्नता होने के साथ-साथ 18 लाख की मांग भी सामने आई थी जिस से संबंधित वीडियो रिकॉर्डिंग संगठन के पास मौजूद हैं और उनके आधार पर ही न्यायालय में आवेदन प्रस्तुत किए गए जिस पर न्यायालय के द्वारा तथ्यों को देखते हुए आरोपी को लाभ दिया गया। अभी पुलिस थाना रिजौर आगे कि विवेचना कर रही है। वहीं 18 लाख रुपए बरामदगी के बारे में कोई सूचना संगठन को नही दी गयी है।

मेरे खिलाफ झूठी शिकायत कर वसूली की नीयत से यह केस दर्ज करवाया गया था। जबकि उक्त महिला बहुत पहले ही अपने एक प्रेमी के साथ निवास कर रही थी, और एक ही गांव के होने से पूर्व में उसके द्वारा मुझसे जो पैसे लिए गए थे वापस मांगने पर उसके द्वारा मेरे विरुद्ध यह कार्रवाई की गई। जिस समय मुझ पर आरोप लगाए गए हैं उस समय मैं पुलिस ट्रेनिंग में था। मुझे कहीं से सहयोग नहीं मिला तो मैंने ज्वाला शक्ति संगठन से संपर्क किया। संगठन और अधिवक्ता ने मुझे दिलासा दिया और उच्च न्यायालय के द्वारा मुझे अग्रिम जमानत दिलवाकर मेरा जीवन सुरक्षित किया गया।
